Clear Legacy is a document preparation service. We are not a law firm and do not provide legal advice. By accepting, you confirm you have read and agreed to all terms below.
1. Who We Are
Clear Legacy is a trading name of Kaizen Finance Ltd, registered in England and Wales. We provide document preparation services for Wills, Lasting Powers of Attorney (LPAs), Trusts, and Probate support in England and Wales only.
⚠ We are not a law firm. We are not regulated by the SRA. We do not provide legal advice. No solicitor-client relationship is created by using our services.
2. Services Provided
We prepare documents based on the information you provide. Our services are:
- Will preparation — from £69
- Lasting Power of Attorney preparation — from £89
- Trust drafting — from £149
- Probate support and document preparation — from £195 (guidance only; you remain the applicant)
💡 Our probate service supports you in making your own application. We do not apply for probate on your behalf or act as your legal representative.
3. Mental Capacity and Free Will
By proceeding, you confirm that:
- You are aged 18 or over
- You have full mental capacity at this time
- You are acting freely and without undue influence from any other person
- You are domiciled in England or Wales
⚠ If you are under any pressure to make a Will, LPA, or any other document, please stop and contact a solicitor independently.
4. Your Obligations
You are responsible for:
- Providing accurate, complete, and truthful information
- Ensuring your Will is correctly signed in front of two independent witnesses (Wills Act 1837, s.9)
- Ensuring LPAs are correctly certified and registered with the Office of the Public Guardian before use
- Storing original signed documents safely and informing your executors/attorneys of their location
- Updating documents when your circumstances change (marriage, divorce, birth of children, bereavement)
⚠ A Will not correctly signed and witnessed is invalid. Clear Legacy is not liable for documents incorrectly executed after delivery.
5. No Legal Advice
Nothing provided through our service constitutes legal advice. Information is for general guidance only. For complex estates, foreign assets, business interests, contested estates, or potential Inheritance Act claims, you should seek independent advice from a solicitor.
6. Identity Verification
We use Stripe Identity to verify your identity before preparing documents. This protects you and ensures your estate planning documents cannot be obtained fraudulently. You will be asked to provide a photo ID (passport or driving licence) and a short facial scan. Your ID is processed securely by Stripe and is not stored by Clear Legacy beyond what is required for compliance.
7. Electronic Signature
Your electronic signature on this acceptance form constitutes a valid binding agreement under the Electronic Communications Act 2000 and the eIDAS Regulation (retained in UK law). Your signature, name, email, timestamp, and IP address are recorded and stored as evidence of your agreement.
8. Payment and Fees
All fees are payable in full before documents are prepared. Government fees (OPG registration: £82 per LPA; HMCTS probate: £273) are separate and not included in our fees. Payment is processed securely via Stripe.
9. Refunds and Cancellations
You have a 14-day statutory cooling-off period. By requesting immediate commencement of work (which you do by proceeding), you acknowledge that your cancellation right reduces once preparation begins. Correctly prepared and delivered documents are non-refundable.
10. Limitation of Liability
Our total liability to you for any claim shall not exceed the amount paid for the specific service. We are not liable for indirect or consequential losses, or for losses arising from incorrect execution, witnessing, or registration of documents. Nothing limits liability for death, personal injury, or fraud.
11. Chargeback and Dispute Prevention
By accepting these terms, you acknowledge payment was made voluntarily with full knowledge of our service scope. Filing a bad-faith chargeback after documents are delivered constitutes a breach of this agreement. We maintain full records of all service delivery and accepted terms. Before raising any dispute, contact us at hello@clearlegacy.co.uk — we will respond within 2 business days.
12. Data Protection
We process your personal data under UK GDPR and the Data Protection Act 2018. Your data is used solely to provide our services. It is not sold or shared with third parties except as required to deliver our services (Stripe for payment and identity verification, Formspree for form submissions). 13. Governing Law
These terms are governed by the laws of England and Wales. Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
